Summary of the House Committee Version of the Bill

SCS SB 901, HCA 1 -- ENVIRONMENTAL CONTROL

SPONSOR:  Goode (Townley)

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee on
Conservation and Natural Resources by a vote of 20 to 0.

This substitute changes the regulatory authority of the
Department of Natural Resources on underground storage tanks from
the Clean Water Commission to the Hazardous Waste Management
Commission.

The department can adopt rules and regulations more stringent
than the United States Environmental Protection Agency's rules.
Any rule, except those made by the Petroleum Storage Tank
Insurance Fund board of trustees, will be adopted after due
notice as required by Chapters 260 and 536, RSMo.

HCA 1 -- Adds language to Section 260.370 that it will prevail if
there is a conflict concerning authority for the risk-based
remediation rule involving Section 644.143 or 644.026(8).

FISCAL NOTE:  No impact on state funds in FY 2005, FY 2006, and
FY 2007.

PROPONENTS:  Supporters say that moving oversight from the Clean
Water Commission to the Hazardous Waste Management Commission
will make it easier for the Department of Natural Resources to
make rules and regulations regarding underground storage tanks
and improve their response time to accidents.

Testifying for the bill were Senator Goode; Department of Natural
Resources; and Hazardous Waste Management Commission.

OPPONENTS:  There was no opposition voiced to the committee.
